Is It Legal to Wear an American Flag Bikini?

The question comes up every July, and the answer starts with the U.S. Flag Code. Section 8(d) of the code says the flag should never be used as wearing apparel, bedding or drapery, which is why so many people wonder about flag swimwear.

The Flag Code is a set of guidelines for respectful display. It sets out no penalties and has no enforcement provisions, so following it is voluntary for civilians. Supreme Court decisions in 1989 and 1990 also treated laws punishing the treatment of the flag as a free speech matter.

There is a practical distinction too. The guidance concerns an actual flag being turned into clothing. A swimsuit cut from printed swim fabric that shows a flag design is a garment with a pattern, in the same way a beach towel printed with stars and stripes is.

Whether to wear one is therefore a matter of personal taste and occasion. Many people keep flag prints for holidays such as the Fourth of July and Memorial Day, and choose a looser palette for the rest of summer; red white and blue bikinis show that wider range.

A few habits prevent it. Straight after swimming, give the suit a cool rinse on its own or with other dark pieces. Avoid soaking it, and avoid leaving it rolled up in a wet towel, since that keeps the colors pressed together while damp.

Drying matters as much. Lay the suit flat with the white panels spread open so they dry first, and keep it away from other damp clothes in a beach bag, where dye can transfer in both directions.

A new suit deserves one extra check. Give it a first rinse in a basin of cool water and look at the water afterward; a pink tint means the red is still releasing dye, and the suit should keep being rinsed separately for a while.
